CRITICAL OPERATIONAL NOTICE: NicotineWire is an automated informational data aggregator. We are not a law firm, regulatory consultancy, or government enforcement body. Customers retain sole, independent responsibility for statutory compliance prior to authorizing physical warehouse shipments.

1. Informational Purposes Only • Not Legal Advice

NicotineWire (operated by Half Radiation, LLC) aggregates, parses, and indexes publicly available regulatory dockets, state revenue directories, and corporate SEC disclosures via automated pipelines.

None of the data, classifications, ERP recommendations, risk scores, or delisting alerts provided via this service constitute formal legal, financial, or regulatory compliance counsel. Subscribers must consult qualified regulatory counsel admitted to practice in the relevant jurisdiction for official interpretations of 21 U.S.C. § 387, Florida Statute § 569.31, or related statutes.

2. Customer Retains Sole Responsibility for Shipments

The Customer, whether acting as a manufacturer, wholesale distributor, retail chain, or freight broker, retains complete and sole legal responsibility for verifying state directory certifications, PMTA authorization orders, and local licensing requirements prior to executing physical inventory picks, generating shipping manifests, or tendering cargo to common carriers.

Customer explicitly agrees that NicotineWire's automated ERP feeds and shipping hold recommendations are operational conveniences and do not relieve Customer of independent statutory verification obligations under federal or state law.

3. "As-Is" and "As-Available" • No Warranty of Accuracy

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, NICOTINEWIRE AND ALL ASSOCIATED SERVICES, APIS, FEEDS, AND DOCUMENTATION ARE PROVIDED STRICTLY ON AN "AS-IS" AND "AS-AVAILABLE" BASIS.

Half Radiation, LLC explicitly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that data feeds, directory scrapes, or webhook dispatches will be 100% complete, error-free, uninterrupted, or real-time.

4. Limitation of Liability • The Strict Monetary Cap

IN NO EVENT SHALL HALF RADIATION, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• State revenue department cargo seizures, truck detentions, or inventory forfeitures;
• FDA Center for Tobacco Products Civil Money Penalties (CMPs) or warning letters;
• Lost commercial profits, business interruption, or loss of retail distribution licenses.

THE TOTAL AGGREGATE LIABILITY OF HALF RADIATION, LLC ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE USE OF NICOTINEWIRE DATA SHALL IN NO CIRCUMSTANCES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT ACTUALLY PAID BY CUSTOMER TO NICOTINEWIRE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

5. Corporate Entity • Governing Law

This agreement is entered into with Half Radiation, LLC, a Delaware Limited Liability Company. All commercial contracts, Stripe billing cycles, and enterprise API licensing shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice or conflict of law provision.
